I got married in Feb 2019, I am working in Software. My husband started a company but he is not putting efforts to run the company successfully. Its been 3 yrs since the company started but his total income was around 1 lakh only. We bought a house in joint name but i am only paying emi 36k per month. my husband did not pay even a single penny though he promised that he will do business & give. i am running the family from day 1 after marriage till now he had not contributed for me & 15 months baby.he didnt contribute for basic expenses too.. he seems to have mental issues too. now i want to separate the property to my name alone as his controibution is 0. 2 yrs i have paid emi. pls let me know the process
A.I suggest you discuss this matter in brief with ur husband. Request to talk about your future plan to continue the marriage with your husband as well. If he agrees, you can execute a release/ gift deed to get the portion of the property in your name. U may need to get NoC from the bank as well. However, if he does not agree to transfer the property in your name, you must consult. lawyer to get a declaration order from the court.
