i was working in a north east state and faced charges of mental harrassment by a girl working in my office. ICC apointed by Management was not as per standarad and from local place who were motivated & acted in a planned manner. without any fault, I was declared guilty and faced show cause notice. I tried to clarify my side but in vain. I require some advice and expert actions to defend & revert the unlawful actions of ICC.

A.Dear client,
It shall be relevant to state that the term “Mental Harassment” has not been explicitly defined anywhere under the Indian Penal Code 1860, however, the notion of harassment can be interpreted in terms of cruelty or torture. The relevant sections are as follows: Obscene Acts and Songs under Section 294;Assault or Criminal Force to Woman with an Intent to Outrage her Modesty under Section 354;Word, Gesture, or Act Intended to Insult the Modesty of a Woman under section 509.The remedy to the situation can be- A complainant making false allegations and lodging fabricated FIR shall be punished with: Imprisonment of either description for a term which may extend to two years, or with fine, or with both. If the criminal proceeding is instituted on a false charge of an offense punishable with death, imprisonment for life, or imprisonment for seven years or upwards, then the complainant making false charges shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Sir,
The incident happened on 11.07.2020, ICC sat on 27.09.2020, received an advsory memo on 04.11.2021 (To be careful in future) from the Dept.
May we pursuie the matter now?

A.Dear Sir,
In many cases ICC not doing its honest duty and some one will be the victim of such verdict. You may get issue a legal notice and try to solve the issue legally.
