I have booked flat No D - 1002 at Kakad Paradise, Mira Road on 6th Dec 2015. Now approximately 6 years and nine months are passed now. Builder has taken 99% money already three back and still not given the possession. Every time he is giving oral commitment. Not responding on emails. Owner of the project never comes on a call. I am Seeking for your assistance/advise. RERA Registration number is P51700006750. Note Builder did RERA registration in 2017. And there is no timeline mentioned on my agreement regarding project completion. Since my agreement is before RERA the RERA project date will applies to me ? or Not ?

A.Dear client,
The builder cannot forfeit the booking amount, he can be dragged to consumer forum for recovery and compensation. If he has not given you possession on the said date you can demand refund with interest. You need to send him a legal notice. If he doesn't refund then you can approach rera or Consumer Court.
