Mother has three child..two male one daughter. All three married.. elder son love marraige without parent permission he did engage some one.. daughter married due to some issue it's divorced. Now last younger son married as of now no issue.

Now elder son died as the case daughter in law asking husband share or property. elder son one baby daughter 10 years old.

Mother in law said as my son died in 42 old.. even he was in sick I too take care. You don't have feelings about your husband and asking share. I didn't give.
Now daughter in law said that I can take through court

As others child's like daughter and younger son don't ask and said it's mother property that you can take decision.
Here daughter in law put words that I have kid and no income but she's self employed for doing beauty parlour and husband auto for giving rent based earning daily basis 400 rs/_. Plus parlour income..

For auto financially supported by mother..

Now what kind of solution will be there for above issue or query
Please advice or guide

A.dear client the widow woman can take a share in her late husband property . But condition is that the said widow woman has not remarried after the husband's death.

A.Dear concerned,
The daughter-in-law can claim her share in the property, if the property is ancestral and the mother-in-law can't even refuse to give her share to her. On the other hand, the daughter-in-law can't claim her share in the property, if the property was acquired by the mother-in-law herself or through her own income. As far as the income from auto-rickshaw is concerned, it has nothing to do with the share of the daughter-in-law because the cases are decided on the basis of facts and laws, not on the basis of feelings and emotions. A.The widowed woman can take a share in the property of her late husband. But, while the said woman has not remarried after the husband's death.
