Mother has a land Lord. But son wife asking share as a son died even having one baby girl 10 years old. issue is both married against parent and stay separately. Due to son health problem mother care medical treatment as well as other expenses. Now son wife said orally that I will go court for taking husband share But all property owner son mother.. Mother even attend son marriage as he left home in bachulor time..
Now what mother will do as no such relation will be there. But mother in law told I will care my son daughter at the time of her higher education or her marraige expenses.
Even husband share she's asking but mother told my son died now what relation you maintain as the case
Mother old 60 Now. Son died three month back now suddenly putting pressure for property share.. some doubt will arise as son died suddenly due to pressure her wife asking share even he don't ask share because he married against parents.
Please advice what steps mother will take.

A.She can not claim a share in Mother in Law's self acquired property.

A.Dear client Widow is only entitled to get her husband's property. Widow is not entitled to the self acquired property of her mother-in-law during her life time. Only after the demise of the mother-in-law dying intestate the widow and her children are entitled to the share of her deceased husband in his mother's property.

A.Widow is only entitled to get her husband's property. Widow is not entitled to the self acquired property of her mother-in-law during her life time. Only after the demise of the mother-in-law dying intestate the widow and her children are entitled to the share of her deceased husband in his mother's property. However if the mother-in-law had gifted or made a Will excluding the widow from her property then the widow nor her children will have any right in the property of the mother-in-law.

Tell her go to which ever court she likes she won't get any relief from any court. This is the law of the land. Widow wife has no right in the self acquired property of her mother-in-law.

However she can get some relief under PWDV Act to live in the share household. PWDV Act does not create a separate tilte in the property. She cannot think of claiming any share in her in-law's property. You can refer to Supreme Court Judgement.

A.A legally wedded wife can claim on husbands share in the property, better to contact a Property Expert Lawyer from the Vidhikarya panel on all aspects of the issue.
