Property given on rent with registered agreement expired in July18.
Tenantdoes not provide rent on time, monthly rent received after 4 months on repeated followups.
Cheques provided bounces.
When ask them to vacate premises and clear previous dues, they does not respond.
On follwups , talks rudely.
Neither give comsent for agreement renewal

What to do, pls guide?

A.need to review the agreement to ascertain whether the agreement is of Leave and Licensee Agreement or Tenancy Agreement. If its a LLA then he/she will not be protected under the tenancy act. Send a legal notice for default and breach of contract. Contact Vidhikarya for allotting a local lawyer.

A.Dear client,
Mr. Jha has aptly advised in this case. Besides written notice, you must file both criminal complaint under 156 (3) of CrPC (if not able to lodge FIR) and also case under NIA 138 for better results.

A.you can well see the position of the rent due, and can not be claimed on acceptanc of arrears of rent due/acceptance of payment of bounced cheques. IN FUTuRE , when the cheque is bounced or rent arrears due, you can claim eviction. . For details, pl. contact some advocate through vidhikarya.com

A.Dear Client,
File a civil suit for ejectment of tenant or rent control case for vacation of tenant and take directions from the court for depositing the rent into the court or in your bank account. It should be on the basis of monthly rent. If any cheque is given for rent is bounced you can file a cheque dishonour case.

A.Dear Client, give them written Notice to vacate, mention as payment due also , given cheques bounced. deposit the cheque again in bank, if again bounced , file a criminal FRI for 420, 415, 467, 468, also a separate case for cheque bounce.
