A.Dear Client,
Under some exceptional circumstance you can file a divorce petition within six months as per section 14 of the Hindu Marriage Act, however, you have to wait 1year and file a petition for divorce under mutual consent and pay the all the amount by way of DD or cheques before the court only.

As per section 14 (1) of the HMA, no petition for divorce can be presented before one year has elapsed since the date of the marriage. But proviso to the said section also empowers the concerned court to entertain the petition even before the prescribed period of one year has elapsed on the ground that the case is one of exceptional hardship to the petitioner or of exceptional depravity on the part of the respondent. In short, you can file a divorce petition even within one year of marriage. A.Yes, but on what grounds you apply for divorce you must disclose to the court. Now you need not wait for one year after marriage for applying divorce, but you must state reasons for applying for divorce within one year

A.It should be more than a year to apply for divorce. However, party can approach the high court with strong grounds to waive off this period. If the high court is satisfied with the grounds to waive off then it's the discretion of the court to allow it or not.

A.Under HMA, Divorce is maintainable only after the expiry of ONE YEAR from the date of the marriage. But Section 14 of the Act empowers the Court to waive off this one year period under exceptional circumstances. The petitioner is required to give cogent and valid reasons.
