PDC validation - want to pay a postdated cheque
1 year ago
Good morning. My brother in law's want to pay a postdated cheque to my wife for foregoing her share in a property. They are asking her to sign the document at registrar office. At present their intentions seems to be genuine. What I need to know how to proceed in this case and what agreement I should take along with post dated cheque. Please help.
A.Dear client,
it is not always advisable to issue a post-dated cheque. This is because there could be possibilities that you may not be able to honour the cheque on the given future date.

A.Dear Client
Since she is forgoing her rights in the property, if any, and asking her to execute the documents for registration then she needs to have not only the PDC in place but also some legal document to ensure that all the arrangements are mentioned there.
If she is giving away her share of property then she must be compensated well. If only PDC is the way then through a document/agreement she must make her brother liable for payment today or tomorrow.
