Retirement benefits to woman under maintenance
6 years ago
Under the RTI act, a lady, who is receiving maintenance amount from pension of an ex government employee, has asked retirement and terminal benefits due to her husband (living separately). There divorce case is subjudice in the court of law. The ex employee does not want the lady to avail these retirement or terminal benefits and thus does not want his details to be shared with her. Can a luminary please throw some light
Firstly whether the retirement or terminal benefit amount be disclosed to the lady under RTI?
Secondly Is the lady entitled to his retirement or terminal benefits if she is receiving maintenance and the husband does not want to share with the lady?

Please find the following advice:
1) The first information officer will send the respective RTI application to that ex-government employee and may ask to remark the same and upon that he will decide whether to share the pension details with the applicant lady or not.
2) Yes, if the lady is fully dependent on the husband and if he does not have any other source of income then as per the court order she may be entitled to get the terminal benefits/retirement benefits if court orders so.
