My marriage is second marriage. My first husband is expired. So I adopted my daughter to my second husband [court marriage and registered adoption deed], but my husband filed complaint and he want to cancel my daughter adoption deed so can this adoption is get canceled or not ? What is the rule

A.Dear client,
As per HIndu Adoptions and Maintenance Act, 1956, Sec 15, No adoption which has been validly made can be cancelled by the adoptive father or mother or any other person, nor can be adopted child renounce his or her status as such and return to the family of his or her birth. So, valid adoption which is registered cannot be cancelled.

A.If your husband wants to cancel the adoption deed then he have to seek permission from the competent court of law otherwise he cannot cancel such registered deed of adoption by any other means.

A.Dear Madam,
once it is registered then adoption deed may not be cancelled by any court for whatever reason your husband may take. However, you have to contest such suit if any filed by your husband.
