Hi sir/madam, we need your guidance before to proceeding to file any case My name is Vijay, My mother's father have ancestor Farming land (mother's father died in 1990) of total 5 acre land out of them 2 acre, my mothers elder brother has been taken as a purchase from my mother's father & now is with his name, & rest 3 acre is on my mother's rest brothers name, so can we file a civil case on court to claim on total 5 acre for equal distribution (my mother didn't made any registered document to leave herself property claim earlier)

A.Dear client,
Your mother cannot claim the 2 acres bought by the elder brother. It will be his self-acquired property now. But she can claim over the money he has paid to buy that property. It should be shared among all the children equally. She can right to property on the 3 acres of land. Under section 6 of the Hindu Succession Act, women have equal ownership of ancestral property as sons. So, consult a lawyer and initiate the proceedings.

Hi sir thanks for you response & guidance, is there any way to claim on 2 acres (mean is there any solution/provision on law) because my mother's elder brother taken that land from my mother's father, the way he used to purchase it, is not correct or can we find something provisional condition to buy it as per law.
