I'm a BDS student and I am responsible by mistake for hand fracture of one of my batchmate. The incidence had happened in the month of August. My college disciplinary committee had decided with the consent of his father that I will bear the hospital expenses. But, since one month his family is threatening to kill me if I won't give them the amount of 1.5 lakh. They're localites and tried two times to cause severe physical damage to me. Right now I am posting this from my home because I am afraid to go to my college. PLEASE HELP ME!!!

A.Sir,
What you done is a crime and bailable and the other side did a crime non bailable so you lodge a complaint before the police then they will automatically come for settlement.

A.lodge FIR to the police authority and bring this threatening in the notice of the college committee. As only with the interventin of police and college committee the matter can be solved . or details pl. contact some advocate through vidhikarya.com

A.Dear Brother,
It is not your intention and you will get all types of protection if you appreaoch local Superintendent of Police of your district and he will speak the SP of that district. There are so many options. You should not afraid of any body. Speak to any of the expert on phone. Cheers. If there is no intention no body can be punished.

A.First of all, File a police complaint about threatening and their Conspiracy and 2ndly file a writ petition against the order passed by the Disciplinary committee in the High Court.

The injury made by me is fracture of radius and ulna of forearm. The incident had happened when he called me to his room alone.

Sir,
Your case like a double edged weapon.

First you committed a crime U/S 338 IPC and you are liable for IPC offence and others threatening you U/S 506(1) IPC and extortion IPC.

Initially his father called me and asked me to transfer the amount of 1.5 lakh into his account otherwise he will file an fir. I told him to talk to college authorities as I was directed to do. Then, when he came to college, the college authorities made a settlement of paying hospital bill in front of my father and him. He and my father has signed the settlement paper work made by college. The work is not made on court stamp paper but on college letter pad. But, now he is saying he is not agreeing with it and threatening and trying to harm me since then. I agree that I have committed crime but is it fine to ask this much amount in return. I am very much confused. Some says file a police complaint. Others say you have also committed crime so don't take it to the police.

A.What injury or damage has been caused by you has not been mentioned. However u appear to have entered into a compromise. In any given situation, other party has no right to start giving threats to u.if they want , they can sent a complaint to local police station. U should share details of injury caused by y to get better guidance

A.Dear Client,
This case could have been solved between three parties(one, i.e., you, second ,your friend to whom damage has been caused, three, the College Authorities i.e.,Principal and Disciplinary Committee.
Presumably the College Authorities might have asked you to pay the or bear the medical expenses not the fixed amount of 1.5 lakhs. Under the circumstances bring this matter immediately before the Notice of the College Authorities and if it is not solved then file a FIR in the Police Station immediately.The Law will take its own course. Nothing more could be said at this stage.

A.Facts not clear. What do you mean by severe physical damage. Be clear when with facts as legal opinion cannot be delivered with incomplete facts. For the sake of your understanding, if you had sustain physical injuries you should have obtained medical certificate from government hospital for such treatment which automatically becomes a police case. If you haven't, then I suggest you lodge a complaint with the local police station against them for criminal intimidation.

Sir, I have not sustained any physical damage yet because at first time his father had pushed me down in front of the college staffs last month and recently his brother along with some of his local friends tried to harm me just outside the college campus. I didn't got any injuries as I was on bike with one of my batchmate and we escaped by chance as they were 15-20 people. His father is threatening since the month of August that I won't let you study here. The actual hospital bill is of 30,000 but his father has produced the bill of 80,000 which is fake as I have confirmed it from the hospital. And, he is demanding 1.5 lakh as compensation. Initially he said he will file a case on me if I won't give the amount. But, when he learned that mistake is of his son he has started this.

A.Immediately report this to your college authorities and let them know about it so that they speak to the fellow student's parents.
Secondly make a complaint to the local police about the incidence so that in case of need they can help you.

Sir, I have reported this to the college authorities and they have assured that they will take action against them. Also, his father's behaviour is not good. And, after the incidence which happened 3 days ago I am very much scared to go anywhere outside the campus.
