My account turned NPA and the bank took symbolic possession. And immediately without prior notice they auctioned the property and applied for physical possession from the DM. We got a stay on the auction and the physical possession in 2017 and we were told to pay the bank we did go and 3 times they refused finally I took it from them in writing that they will not not again in 2018 we approached the bank to clear the loan but they refused. After that we had COVID issues and my husband got affected in the first wave with COVID and he became a heart failure patient. The bank had not approached us or intimated us and then now in Oct 2022 there is a possession order which was only 1 day later from the DM on a DRAT order which is passed ex parte. We were not notified or no summons were sent. We approached the collector office and they said they had no staff to serve the notices because of holidays We told them the entire episode and they said legally we were due for 15 days notice period. Now we want to approach a higher court as the bank is deliberately harrassing us and not accepting the money and is after the property only. The property value is 1.5cr and the loan amount is 47 lacs

A.Dear Client
You should immediately take action against the bank authorities on such misconduct.
You should contact a good advocate of Honourable high court and put forth your concerns.

Sir I did that on the 25/11/2022 but it’s at a pre admission stage in the high court and the next date given is for 2//12 and the judge asked my counsel to approach the DRT with an appeal as the possession notice due date is for the 29/11/2022. My worry is I have tenants that are you r girls in the house and I dnt know what else I can do.

A.You should immediately contact any good advocate of Hon'ble High Court and consult with him along with all the relevant documents regarding the said loan dispute. Immediately action should be taken on behalf of you against the bank authority.
