Guidence to get justice
Respected Lawyers. I took a housing loan in Jan/2015 using Special power of attorney for co applicant stating only housing loan and limit of 35lacs. As i was abroad. I came to India and sold the house in the same year in October. I took advance from the buyer and went to registration office and registered the house for the buyer. Later came to bank to close the loan. Then i noticed that co applicant took an excess loan of 3.18lac without my concern and notice. I raised the issue then manager said it is legal because you have power of attorney. I agreed and paid that loan from my account. It's was not joint account. This year in June i came to know that it is illegal and for clarification i went to branch, head office and also ombudsman. All says i have paid already and loan is closed so i cannot raise issue now because it is 7years old but no clarification have given by any. I want to fight because i believe have undergone fraud. Can I go to court? How many days it ll take?
You are correct. It goes on the principle “Nobody can enrich at the cost of another or misleading another”. It is nothing but day light fraud. The Banking Ombudsman always sides the Bankers. You may go to High Court and fight to get justice.
As you have willingly paid the loan amount and it's already been years.
You can still file an FIR or you can file a suit but time can't be determined from now.
