Divorce

How can I get divorce after separate from 5 years? I have 3 children and I am living sepratally from 6 years because of mental torchar he force me to abortion for 4 times because of girl now I want to divorce plz help me I don't want money I need only divorce how much it will take time plz I don't want to any relationship with him.

You can opt for mutual consent divorce (MCD) which takes six months. For this both the parties to the marriage needs to move the application together one at the time of moving the first motion and thereafter on the second motion after six months. But before you file MCD you should enter into a settlement agreement or MOU for a lump sum amount as alimony and maintenance of the children.

Alternatively if he doesn't agree for MCD or lump sum amount, you can file a divorce petition on the ground of cruelty along with maintenance petition. As per the Supreme Court ruling estranged wife entitled to get 25% of the net salary of husband as maintenance for herself and her children.

Mam, You can file a divorce petition in the court through some advocate as well as Domestic Violence as you have appropriate ground to file it.

You have 3 children , you will have responsibility , if you would able to do , then ok, or may also opt during Divorce case , for Alimony / maintenance/ Financial support under D.V act, You may file for divorce.

Dear client at present u r suffering from nervous breakdown due to your sad past. Come out of it and file a case of maintenance. U will get sufficient amount for u and for education of your children. At present due to money problem u r not keeping your children with u , but when u get money u will be able do keep them with u. Do not file a case of divorce.

How much time it will take to get divorce will depend upon pace of the court proceedings. Divorce with mutual consent takes lesser time.

If you are living separately since last 5 years with 3 children and no longer interested to continue the abusive relationship, you have every right to file a divorce.Please ask Vidhikarya.com to find out a good Advocate for you to take up your case. But I fail to understand how will you manage 3 girls(?)/children for their upbringing and education etc.
