Hi Sir, I wanted to know in the LAW under the BDA Law do we have any provision to get a BDA site of our own agriculture land which was acquired by Government long back.
Brief - BDA had acquired our agriculture property in the Year 1980 and provided a compensation to our uncle who was heading the family and he utilized the same. Later my father realized that we didn't have any property of our own so, why can't we raise a request to BDA asking for sites to us since, we had our old temple and big well there . From Year (1981) till today (2022) BDA has not developed the small lands next to temple or acquired that part of land or allotted that land to anybody it is still left vacant. As we had built a small sheds there very long back in year 2000. My Father has filed several request to BDA from 1981 till today for allotting back the un-developed land to us for which we would pay the cost of land. But the BDA personnel's are replying back saying that the original land owners cannot buy back their own land or site in their land or neither their is a provision to allot it back to land owners even if we want to pay money to buy it. So, can you please let me know if there is any provision or Law or section under which it states that the Land owner can buy a Site in his own land buy paying money to BDA the cost of it.

A.Dear Sir,
Such things will be decided and raised at the time of acquiring the land and before compensation was determined. Anyhow if there are valid grounds you can claim a site since in many cases BDA is allotted one or two sites in favour of land owners.
