My house in under construction and building materials are in front of my gate which is nowhere affecting the lives of society. In my colony there is no sewer constructed by the government, hence every body use to flow waste water in open area. But I never did this. I had invested 30,000 Rs and made a shot pit covered close to my wall. I got a notice from municipality to break it and remove all materials within 3 days. In my colony there more than 100 houses under construction who have their building materials in front of their gate, but municipality didn't served notice to any body. All these things are being done by one of our neighbour who is a contractor against whom we have filed a case of 107 pending in the court of SDM. Please suggest what to do? My shot pit is made to keep environment free from pollution, and building materials will soon be taken inside. But municipality has sent the notice to break and seize and material within 3 days.

A.Dear client kindly go through any expert lawyer who knows municipal law .You can approach to court with filing measurements petition and get your land secured.

A.Dear Client,
Please contact one local Advocate who si good in Municipal Laws.The Municipality must have a retainer Lawyer to appear on their behalf.Local Court Bar Association will be in a position to give the few names.In order to get out of the crisis you please file a Petition after taking measurement of your land but even if it is your land you must look for public safety,decently,health etc into consideration.

A.Dear Client it is saying that we must not fite with our neighbour. Our neighbour , how ever bad he may be but afterall he is our neighbour. u say

It is clear that your construction is not your own land , but it is encrochment, and for it u must have got previous permission of municipality and that u have not done.
Dear client Law can not help u. Law can not legalise an illegal work.

A.Send a legal notice in reply to the notice and appear before the concerned hearing officer, as it is mandatory for the municipality to give an opportunity of being heard before passing an order. Alternatively you can approach high court by filing writ petition for appropriate direction.
