A member of our society contested election by hiding the fact that he is not a Bonafide member as he had gifted his flat to his daughter one year back . can he be in the committee or remain chairman, by getting elected

A.Depending upon the rules and regulations framed by the election committee, it shall be governed whether he has the right or not. Moreover, when he was the owner he was definitely a member of your society but since he have gifted the said property to his daughter so does he looses the right to be a member of your society?? If your election committee frames such rule then everyone should follow such rule only otherwise he has the right to get elected by the free will and consent voting by the members of your society.

Do your housing society have any such rules and regulations.
If not then,the condition that he has gifted his property to daughter , does not completely seize his right to hold a position until and unless your housing society has such a clause.
He once was an owner and now has family members, with whom he might stay and can claim a right to hold a position.
