I signed a Bond on my Offer letter on 7 October 2022 which stated if I resign before completing 6 months, I will have to pay Rs 50000 as training expenses. No such external training was given to me during my tenure with the company for which the company had to incur expenses. I filed my resignation on 12 December 2022 as I got opportunity to study Abroad for my masters. My salary for December 2022 is being held and it is being adjusted in the 50000 bond that I signed.
Also I have 5 Annual leaves which incurred during the time I worked with the company. My reporting manager is denying me that You cannot take Annual leaves during your notice Period.

Please guide me that Do I need to Pay the bond amount and can the company hold my salary for 2 months as they are adjusting it towards my Bond amount.

A.Dear Sir,
Such Bonds are usually but you should not share any cheques in their favour. It is very hard for them to recover Rs.50,000/- bond amount if you discontinue before 6 months.

A.Hi client,

The decision of paying the amount or not paying the amount, will rest upon the agreement clauses you have agreed to. It is advisable to let an advocate the review the entire agreement for a better understanding and to see that whether you are liable to pay or not.
If the clauses agree that it will be adjusted from your salary , then you do not need to pay separately.

A.Hello Client,

You have to look into your offer letter more for the details. As you mentioned that you have signed the bond knowingly then yes you have already given your consent.

since it was mentioned that you have to pay 50k if you leave the company before the mentioned time period, they can adjust the money with your salary or else you need to pay them.

And yes, most of the company have this policy that during the notice period, you can not take annual leave.

But you can have a conversation with HR regarding the issues once.

A.Hello Client,
The first thing to be taken into consideration is if that bond was stamped or not. If the bond was not stamped then the company cannot force you to enforce the same. However, in case it was stamped and you have already signed it, it is a valid contract. You can talk to the HR and explain the situation and figure it out. About your annual fees, it is important to know the company policy. If the policy does not state anything of that sort that you cannot take leaves during the notice period, then you can file a complaint for the same.
