I am separated from my wife, living separately since last 8 months. I have still not put in papers for divorce. I have one son 10 years old. I am in a relationship with another woman. She has a 11 years old daughter. I want to adopt her daughter and give her my name. What is the procedure for the same?

A. Dear Client,
In the present circumstances you can not Adopt.
First , it is not legal to live in relationship with another woman while your marriage is still legally valid.
Second, you can not adopt without the consent of your wife .
Third, you can do so only after the divorce and paying adequate and sufficient compensation to your wife and child.
Only after Adoption you can give ,name,title(surname) etc as per the law and set procedure as well as customs.

A. By advocate Rameshwor dadhe dear sir you cannot adopt the daughter. Because u are not given divorce to the Ur legal married wife.witout her consent u can't adopt children.

A. Dear client Just think yourself and use your own brain. When u have not taken Divorce from your first wife then your marriage or relation ship with other lady is null and void. Your first wife and your valid son is entitled for maintenance and share in your property. U will get only 1/3 of your property.
According sec 7 HIndu Adoption And Maintenance Act 1956 husband can adopt a child with consent of his legal married wife. so if your First wife consents for it only then u can adopt.

How can u do it when she is not your child? Let her use her own fathers name. u r having illicit relations to other lady which will create problem when u will get old.
