I am working in a institute since 2015.
When I applied for meternity leave in 2021, My institute asked me that "you must sign a bond for not leaving this institute for next 2 year after rejoin if you want to avail meternity benifit . And in case of breach the contract , you have to pay all meternity benefited amount. Which is 6 months salary." And as a security they take undated cheq.
Now after 6 month of rejoing, i want to resign from job. Can I have to pay my meternity benefited amount (6months sallery). Or such bond is iligle? It was just for daranae ke liye.??

A.It is completely illegal. No institute can execute such bond and moreover you should not have signed such document also since it is a statutory guideline that you do not have to repay any Statutory Maternity Pay or Maternity Allowance and you should continue to receive the salary from your Employer/Job Centre Plus for the full 39 weeks even if you resign before the end of the maternity pay period also. In your case, you must approach to an advocate for taking legal action against the said institution.

No institute can execute such bond and moreover you should not have signed such document also since it is a statutory guideline that you do not have to repay any Statutory Maternity Pay or Maternity Allowance and you should continue to receive the salary from your Employer/Job Centre Plus for the full 39 weeks even if you resign before the end of the maternity pay period also. In your case, you must approach to an advocate for taking legal action against the said institution.

A.Dear Madam,
such bond is illegal and your management can't recover any amount on the basis of such bond. If u r not in requirement of relieving letter and experience letter, then u can just resign and come out of the institute.
