Can CJM still issue summons
Party A files a criminal case under section 420 / 384 /120B against Party B C &/D After police investigation police files chargesheet & submits in CJM court which takes cognizance of the chargesheet. Party B & C goes for criminal revision under section 397 to District t Judge which is later transfered to ADJ spl ..which is pending ...My question is Can the CJM keep sending summons to Party B C & D or only to Party D..or ADJ has recalled the file from CJM and summons will remain pending till criminal revision is disposed off...
A.Hi client,
It depends upon the merit of the case. It is better to check the records in the Learned CJM court.
Thanks and Regards

A.Dear Sir,
If no stay is granted by the higher court then CJM has powers to issue summons. Please check the status in the ADJ Special Court.
