I married with a woman of other state of north East. She was not in the mood of living with me and my parents from day 1 she showed discontinuation in married life and one day she left home with a false excuse and never came back. After 2 years she filed a divorce on the ground of cruelty and text me that she is going to remarry and giving me consent for the same, the divorce case is still in process. This month on October, I got to know that she remarried there at her place. Now what should I do or what are my legal opinions? Please help.

A.Dear Client,
IPC/Indian Penal Code is applicable to all Indians irrespective of their state of domicile.Punishment is defined in IPC 494 and IPC 495. That too when the second marriage is in the lifetime of a spouse. It can have punishment varying from up to 7 to 10 years.
Section 494 in The Indian Penal Code, 1860
494. Marrying again during lifetime of husband or wife.– Whoever, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such husband or wife, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
Section 495 in The Indian Penal Code, 1860
495. Same offence with concealment of former marriage from person with whom subsequent marriage is contracted.– Whoever commits the offence defined in the last preceding section having concealed from the person with whom the subsequent marriage is contracted, the fact of the former marriage, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
There are two options left out for you.
1. Go to the Court of law and sort it out.
2.Forget it.
If you cannot go or do not want to go either, then engage an Advocate through Vidhikarya.com who can do the job for you.
