Hi,
Recently my brother passed away, after getting his death certificate my sister in law has stated that she wants to claim his Provident fund. She mentioned that my brother has nominated her for the same and 100% in her name, but she requires a NOC from me and my father, which we have to sign in front of the district magistrate. Is this true that even though she is the only nominee entitled with 100% of the money she still would require a NOC from the immediate family members..

A.Nominee means only trustee and not necessarily beneficiary.

A.dear client in your case She has to get the Legal Heir certificate and has to submit the same before the PF authorities along with the nomination certificate and then she will be eligible to get the entire amount of PF in her name.

A.A.Every employee who joins the EPF Scheme is required to furnish a declaration and Nomination Form in Form 2 (Revised) to his employer for onward transmission to Regional Provident fund Commissioner concerned. This nomination form enables the member to give details of nominee for provident fund and list of family members and nominee for pension Scheme.
The nomination is considered as a very vital document for each PF member because in case of death of a provident Fund member,the Provident Fund balances are payable to the nominee in the first instance.

A.Sir,
Nominated person should submit the legal heir certificate.On the basis of the certificate the PF authorities take decisions.

A.Hi,
After death of Member Nominee is eligible for Provident Fund duly declared in prescribed Form No2. There is no provision for NOC.

Sir, my sister in law said she requires an NOC from me and my father, even though she is the only entitled nominee, she would send a form which we have to sign and send it back to her, should we do it
