Employee is forcing us to relieve him before his relieving date as per the notice period. Can we hold the employee till his official last working day? Our Notice period Clause says(15) Notice Period: Your services can be terminated with three months’ notice or basic salary in lieu thereof, on either side and/ or at the discretion of Management. However due to exigencies of business, the Management may at its discretion reject the salary in lieu of notice and ask you to serve the entire or part of the notice period and you shall not be deemed to have been relieved of your services except upon issue of a letter by the Company to that effect.

A.Dear Sir,
U can ask your employee to continue to serve for notice period as there is a relevant clause in your offer letter.
