Dear sir. My sister got registered fir 498a and 406 against husband. Now we are going to make compromise by filling mutual consent divorce and quashing of fir. My question is that will fir be quashed before final motion of mcd 13b or has to wait till the decree of divorce

A.dear client if charge sheet is not filed then request the police to file no case report. Otherwise he has to approach high court for quash FIR.

A.Dear Client,
Yes, you are right,FIR to be quashed first.
The next step would be to file the Divorce by mutual consent under 13 B of Hindu Marriage Act,1955.
If you will be sincere then it can be completed in less than 6 months.
