A.Dear Sir, You will convince your lawyer and to file application before the concerned court under Order 13 Rule 9(1) of Code of Civil Procedure; first u get the certified copy of original documents from the Court. Then u apply for return of original documents.while getting back original documents,u deposit in the court the certified copy of documents to substitute original documents. This is the procedure to get back original documents............. please get early because of; naturally after the appeal time is over, the documents and the suit record will be sent to the central record room of the concerned District Court. After few years, except plaint, written statement and valuable documents all the other suit records will be destroyed including petitions/plaints, affidavits, counters, depositions etc.,. Hence it is always safe to take back the documents at the eariest possible time after the disposal of the suit. ..............all the best... by Chandrashekhar Vithal Jadhav, Advocate & Law Consultant, Bangalore.

A.No, it does not take so much of time unless the judgement would have said that the documents will be kept in safe custody for reasons like appeal to the original petition or clearance of any mortgage debt etc. You have to find out the exact reason of delay by speaking to your lawyer and also looking at the decree copy.
