Before filing MCD, settlement deed/MOU needs to be drafted, setting out the terms under which both the parties have mutually agreed to dissolve the marriage. Divorce by mutual consent can be done within 6 months.
You have to follow certain procedures.
Share your complete Case history including the State of domicile,and the nearest Court to your place of residence.

A.Dear Ms Shyama,
If both of you want to dissolve the marriage through mutual consent, then you have to file a petition for divorce with mutual consent before the family court concerned and the marriage will be dissolved after second motion. At least six months of gap is mandatory between both the motions, which can also be neutralized on the discretion of the court concerned.
