Q. Bigamy by my wife

My marriage was on first week of Feb 2018
She left me in first week of march without registration of marriage
Last week of April we signed divorce agreement on 100 Rs stamp paper
I found information that thus agreement is not valid.
Now she marry to other person.
Can I file bigamy against her?
If yes then How can I prove my marriage without registration certificate of my marriage
I have her second marriage certificate copy.
My marriage was arranged marriage.

I want to file bigamy case first and after that divorce case. For bigamy tell me chances of my winning as having perfect proof of two marriage

A. It is not clear as to what exactly you want? Do you want to just create trouble ? You want to retain your marriage or take a divorce. ask for my e mail id and book my services if you want to really move on in this.

A. Assuming you to be a Hindu: If marriage is solemnised as per hindu customs & rituals it is valid marriage. The fact that it has not been registered does not affect the validity of the marriage. Without decree of divorce from a competent court of India neither of you can remarry. Documents required: Marriage Pictures/video, statement by way of affidavit of pandit who recited the rituals of the marriage, statement by way of affidavit of any two witnesses (guests) who had attended your marriage. Copy of the divorce agreement which itself is a vital evidence that marriage was solemnized between the parties. Lodge FIR against her u/s 494 IPC and her second husband u/s 498 IPC.

Thank you sir for reply. Can she file any case against me like dowry, maintenance, alimony or mental cruelty. I don't want to give her any thing. I could be bankrupt also for that. Tell me law with her in my case. I will transfer all my income on my treatable person. If I need it. Any how I m not going to give her anything. And I don't want to file case against her second husband. I don't have any problem with him.

A. Dear Client Sec 494 IPC is for Bigamy and it is non -cognizable offence and is bailable and is triable by JMFC Court. As your own marriage is not registered with her your case is very weak.

A. Dear client your marriage was not registered and she she has also married another person.
So in fact all is over between u and her .U have also signed some papers.
When u wished to live with her why u signed the papers ?
Now when she has married other person and every thing is over
between u and her so why u want to spend your money in litigation ?
Now when there is no objection from her better go and marry other lady.There is no use of this litigation and u r not going to get her back.Be wise and try to understand the actual situation.

Thank you sir for polite suggestions. I have asked for legal help not social help. My mom is paralysed because of her. Some what madness also to my mom. Yes I did mistake to sign that papers but as my best knowledge it is waste paper. Even after filing joint MCD any of male or female can withdraw, I have just signed contract which is not legal. I have waited for her second marriage as her crime. So I can get my best time. In last 6 months my income is increased 15 times only with angerness with her. I don't care about waste of money but as my view it is investment for other guys like me. Indian law is with me. I have nothing hide to her. She left me because of joint family issue. With this issue she should not marry me. She can cancel marriage. But after marriage she left me in a single month. I will take only legal action. I m not going to do any legal crime. May be it is crime in eyes of society. But it doesn't effect Indian law. And m happy to hear that IPC-1860 497 is cancelled will be more happy if offence of bigamy transfer to cognizable offence. And you may have issue about how did I got her marriage certificate without doing any criminal activity. You can't understand it. Be pure professional.

A. Dear sir, you can file case against your wife for bigamy under section 494 of IPC AS WELL AS FOR DIVORCEUNDER SECTION 13 OF Hindu Marriage Act as Wedding Invitation Card,Marriage Photographs are sufficient evidence for yr marriage. For details,pl. contact some advocate through vidhikarya.com

A. Dear client.. Ur marriag was arranged marriage..if marriage is not registered.Np...just attache Ur marriag pics..Ur marriag invitation card.. along with Ur petition..in family court..... file bigamy case against her..

Thank you mem for reply. As she has married to other person can she file any case against me? Can she demand alimony or maintenance? After signed agreement my income is increased 15 times. At that time my income was around 20k per month not increased more than 3lac per month. I m running business and changed business after she left me. I have change all background. Still I can transfer all income to other person income and I can be zero with income and property. I don't want to pay any this to her. Not after even my death. Can she file dowry against me?

Sir she can't file any case against u .. because she already married someone else.. with out giving u Divorce.. she signed Rs100 stamp paper.. that's not valid...
So u collect.. some solid evidence of her second marriage.. any how u r having her second marriage certificate copy that is enough.. now she can't file any case against u..
But u can file case against her and her new husband.. for more details call me.. through Vidhikarya.
