My wife is putting false allegations on me to get divorce. Can i file a defamation case against her

A.Yes, it so happened with a Nagpur based man and Bombay High Court bench at Nagpur found his wife to be guilty of 500 and 506 for calling her husband impotent. You can contact us for the same.

A.Dear Client,
If your wife is not happy with you why are you interested in keeping her?
Instead of defamation file a divorce case as soon as you can.

A.Go by the advice of your conducting advocate. Defamation is not maintainable in your case, unless such statement are published in public domain.

A.Defamation cases have one peculiar element that the wrong things or false things should have been declared in public causing embarrassment for the defamed person. In case of a husband and wife the communication between two are not considered to be under the purview of public domain. Secondly in case of an argument where the allegations are put unless they are proven to be wrong cannot be considered as false and defaming.
For example, if a woman claims in court that her husband is impotent then this cannot be considered as defamation as this is what she is alleging.

As I said this will be an unusual case as defamation is not a strong matter when it happens between husband and wife. Nevertheless, the court may allow your case and then depending on how the case is pursued will the effect on the result. Speak and discuss your mater with a local lawyer by showing all the evidences and facts and seek his advice to file the case in local court.

According to the law . Wife and husband . cannot consider or cannot file defamation case against the each other. Because defamation means any other person except family. Make allegation against u then it will be possible
