My husband and I decided to end the marriage We got married 3 years back and due to his alcoholic disorder and nuisance we had got separated for 2 years, before 1 year my husband has sent me legal notice to come and stay with him in matrimonial house I did not reply to his notice and had a conversation with him and came to a conclusion that we both wanted to get separated and want to file mutual divorce, now I don't have idea of how this is going to be handled because initial legal notice case was not cancelled and can we file mutual now, does my husband have a chance of escaping from mutual divorce because he was not ready to give divorce all of a sudden he is behaving like ok will get separated just wanted to know if any issues from mutual divorce in future

A.Dear Madam,
If your husband is not okay with mutual divorce then you may file contested divorce now itself as the process will take atleast 2-3 years to get the divorce decree.

A.Hello,
As per the information you have given you can file a case for divorce on mutual consent under section 13 of hindu marriage act.
