Regarding NPA

Sir In Feb 2020 I got new Honda amaze on loan from sbi nd provide them my a/c cheques for ecs but they never provide them to my bank and I was requested to pay my EMI in their sbi branch after Corona period was over I again provide my a/c cheques for ecs but again they said to pay in cash in any sbi branch but then I get in little argument with them for this reason and stop paying my EMI and put my account in NPA after I paid the whole amount of 60000/- on basis that in future they will debt EMI from my account but still after they haven't debt a single EMI and now again my account is in NPA and forcing to pay full balance amount in one installment
Is there any solution to deal with them because they already ruined my CIBIL Score
When a retail loan is sanctioned by a Bank following the repayment through ECS mandate, No post-dated a/c payee cheque is required. The authorized Dealer of the vehicle got no role to play when a loan is sanctioned by Bank and mode of repayment of a loan is made through ECS mandate. The concerned dealer of the vehicle is fully responsible for default to make the transaction NPA that injures/damages your CIBIL record apart from other financial losses. Owing to failure on the part of Dealer to deal with the ECS mandate for repayment of a loan through EMI to be deducted directly from the account of the borrower under ECS mandate. Served a legal notice upon the Dealer and reach out to Consumer Court concerned for filing a complaint against the Dealer for deficiency in service and unfair trade practice impleading the Bank as a party to the case claiming refund of the extra amount of interest paid by you and compensation for harassment including a prayer for the restoration of clean CIBIL record.
