There is a land on my father's name. He has three sons. I am one of them. While distribution this land came to my share. But there is no any proof of document that it belongs to me. There is a old house in that land. And in municipality the name is mine only and not my father's name for since it's been constructed (almost 25 years). Now the house is old and we want to demolish and construct new house there. Till now there is no problem. After demolishing the house can my brother's come on this part as a share? Or bring a stay order from court that new construction should be stopped?? What's your advice on this Land... what is process to construct the new house by demolishing??

First you get confirmed your share by way of registered partition deed or Memorandum of Understanding along with partition deed then start construction either by yourself are through developers.

A.Yes sir because Ur are not make partition in legally. It's only orally. U should approach court or file partition suit with other Ur brothers
