Dear Sir,
My father & I had joint ownership of a flat in Bangalore. My father passed away recently, intestate.
We want his share to be transferred to my mother, who resides in the flat currently.
We have a family tree document created recently.
What document is needed for this transaction? There is no clear instruction online
There are no other legal heir claimants - we are hindus.

Sorry to add, My father had two daughters. But my name is on the flat' registration. Both of us are agreed on my father's name is to be replaced with my mother's name

A.Sir, after the death of your father who died intestate [ie, without a will] the rights of the flat in Bangalore is solely yours. As because you are the only joint owner left and your father had no other person to whom such rights were transferred. You will need the following documents to prove your sole ownership on that property. They are:

1. Death Certificate of your father
2. Original deed of the flat
3. Your Govt Id [Adhar Pan etc]
4. Photographs

If in case you need to transfer your late fathers share to your mother, you can do that by way of a deed as after your fathers death you are the sole owner of that property.

A.If Ur father made will deed if yes or if no then first u should approach to the court for succession certificate . With death certificate of Ur father.
