Can accused ask for re investigation under section 173(8) ?

Can accused use 173(8) CrPC for further/Re investigation if the investigating agency is suppressing the facts?
If yes, then what is the stage to use if the offence is trialable by sessions ?

A.If police officer got any other information or evidence concern from Case then he will send to the magistrate any time

A.Dear Sir,
Accused as no local standi except to lodge counter complaint. At the most the accused can seek quashing of FIR or charge sheet as the case may be. The accused can take benefit of no material on record and seek discharge under Section 239 of CrPC.
