My husband is 60 years old. They are 6 brothers and 3 sisters and he is the 8th child. They have a house in barabazar, Kolkata which is in the name of his grandfather. My father in law passed away in 1985 and I have only one sister in law who is alive, rest 2 died years ago. Now my husband and his brothers wants to sell off their ancestral house but the sister's son are wanting equal shares. Are they entitled for equal share?

A.dear client in your matter They cannot claim for equal shares from the entire property, but yes they can claim for their share from their mother's share. also Married daughters are eligible for share in there fathers property.

A.The Sister's son are not entitled to equal shares, they will get share in their mothers share in equal parts.This will realise only when the property is sold.If any will or testimony or gift deed subject to its clauses & conditions.

A.Yes they have a share in it.. but not equal to all other share holders... but according to the share which their mother would have got if she was alive.. the share of the mother will be equally distributed among the children... subject to any will or gift deed if executed by your father in law in the past....
