MY question is ,We have a land in my native its in the name of my mother. In family divided this land 20 years back and its registered to my father . My father expired on 24/2/2004, after that its transferred to my mother . After my father expired . My grand father mad a will in the name of my uncle(My father younger brother) by giving reason he will taking care of me. My question is, this land already partitioned 20years back and now its in my mother name . Still my grand father having rights to Make will? last year my grand father expired and now my uncle put probate case ....Please suggest me , we are facing lot of problems from last 2 years

A.Sir, you can challenge the probate by getting involved in the matter and proving that you are the actual legal heir of that property and that such property should go to you.

Documents you will need
1. Death certificate of Father and Grandfather.
2. Will of grandfather [where it expressly states that uncle will take care of you]
3. Registration of the property in the name of your father.
4. Transfer of such property in the name of your mother after the expiry of your father.
Challenge the probate and get the same issued in your name.

Sir, thank you very much for your comments. I have small clarification already my grandfather given partition to my father almost 20 years back. But still he having the rights to make a will?
