SALARY KEPT ON HOLD because Assistant working under me made cash fraud

MY SALARY IS KEPT ON HOLD because Assistant working under me made cash fraud, and the assistant was presented before management and he has agreed his crime but did not returned money yet.
Does any law in India permits to keep the seniors salary on hold?
and whether such senior should continue to serve the company by incurring further food and conveyance cost till the salary is released?
What should i do in such situation?

A.Sir file a suit for recovery of money or else you can also approach the labour commissioner for the same and get appropriate remedy.
