V r four brother n three sisters. V 4 brother purchased a three storeyed house built in 75 gaj in 2006 on the name if mother. Mother passed away 6 yrs back. All sisters were married outside delhi. Three brother r living floorwise but i hv only one room locked on first floor. From last 4 yrs three of them quarreling on all kinds of issue n not able to sort the proper divisionto get best deal for them. I m living in separate house ten years back. One year back my room is tried to possess by 3 rd brother family n i called police n registered a complain while half of my old goods were also stolen. Police did not FIR n told us to go to court. What action can i take to safegaurd my portion as going to court never resolve issue wasting time n money. None of brother is agreed to one solution.

A.Sir, you can propose them to buy the part of your share and give you the proceeds. as this is the general applied rule. If in case they do not want to purchase the same then you shall have complete rights to sell of the part of your share to a third party who shall probably bring all the more trouble to them. you should explain them the same and solve this matter in an amicable manner.
If nothing works out then you can definitely file a partition suit.

Negotiations r going on. Since 7 people r involved owner of this 75 gaz house. Per person get 10 gaz legally. Outsider cant buy as 12 gaj land will be of no use. The 2nd brother family living top r passing water into walls making house useless... More than 1 lakh water bill is pending... The 3rd brothers wife is shamelessly fights on every issue... The 1st brother family is sick of fighting both the families as they r 60 plus n heart patient. They threatened them in every way... 3rd family offered to buy on cheap prices through eldest jijaji. They r forcing us but v r not ready for it. Plz suggest a good remedy to come out of it.

A.Dear Sir,
You are correct. Better threaten them that you are going to sell your portion to some stranger who must create more troubles to all of them. Then either they come to terms or come forward to purchase your portion or sell it right away and lead a peaceful life.

Be informed that un divided share can be sold and there are persons who are ready to purchase such litigated properties.

A.Give a Legal Notice to them demanding your share, basing on the response from them approach court for remedy by filing Partition Suit
