I got married in 2015. Now i have daughter of 2.5 years. My husband tortures me mentally when drunk. He behaves very badly with everyone when drunk. He do not go to office regularly. M a software professional and he works in bpo. I tried to manage this relationship because it was love marriage but now it became headache to me. Please advise me. I dont feel safe leaving him because he torturs me because of our daughter. Please help me to get out of it.

Lodge a police report with your concerned police station then you go for the Domestic violence case or any steps which is good for you and your daughter.

A.Dear Madam,
First file DV case seeking following reliefs then he will come for mutual divorce which is very easy.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,
4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

A.you have two options:
1. try to amicably settle the matter involving some close relatives and give him another chance keeping in view your 2.5-year-old daughter, else,
2. try to amicably settle the matter involving some close relatives for mutual consent divorce if he agrees, go and take divorce and start afresh,
if he disagrees, then shot Domestic Violence, Maintenance, Police complaint and start litigation

These kinds of situations will increase if you let them to. File a police complaint at your nearest police station. See the steps the police takes and if your husband stops this misbehavior after that. If not, then with the help of a lawyer file a case of domestic violence against him .

A.If u want divorce then u both can file divorce by mutual consent if Ur husband ready to it . Otherwise file complaint against Ur husband on domestic violence
