RCR versus DV

Me and my wife married in 2014....due to adamant nature, me and she gt seperated on oct 2016. I filed a rcr case in november 2016...and sent lawyer notice and court notice to her rented house. She didnt receive and neither turned up for hearing. I published in newspaper thn also she didnt turn up.....after one year, in november 2017, in bangalore, she filed a protection of women case in mmtc, bangalore.....what should i do now?mine RCR case is towards ex-partee.waht should i do....

A.Her non-appearance in the RCR matter is making her case weak and towards your favor.

A.dear client Her non-appearance in the RCR matter is making her case weak and towards your favor. You should take the order of the court in RCR case and prove the same before the Ld. Court at Bangalore and the same is expected to help you in the latter case.Get RCR ex parte decree. If she did not turn up for one year then you are entitled for divorce directly without proving anything more.

A.Get RCR ex parte decree. If she did not turn up for one year then you are entitled for divorce directly without proving anything more.

A.Your RCR is of no use now, except showing in the DV case that you had not sent her away instead wanted her to be back with you. If you are able to show some evidence that she deliberately avoided summons in RCR you have a better defence in DV case. You have not told what were her allegations in DV case.

A.I think now you have to maintain both the case. So ideal would be to get the court order for RCR case and take a copy of that to Bangalore court where you can show that get that case possibly quashed.
