Q. Property Problems With My Step Brother

My mom is in very bad situation as my step brother who is my mom step son he had locked forcefully one of my mom registered flat room.And he demands that he will not open the room as he wants that room and forcefully he locked the door with his lock so that we can't use that room.My father is also not supporting me and mom he is supporting his son who is my step brother and my mom setp son.We are feeling very helpless.Please give some suggestions what to do in this situation

Approach Civil Court and get break the locks put up by step son.

Of i do what you said will he I mean step brother will not leave that easily he will try to do again something to take revenge can't we do something to teach him a lesson so that next time he don't even dare to do any of his bad intentions

A. You must file a domestic violence case against your father and step as your mom is subject to forceful restraint and non cooperation of your father. You can make an application in the same case for the stay in the matrimonial home.

If i do a case will police arrest them or the case will go to the court
and how we will get our room back?

If you register FIR under wrongful restraint police may arrest them. If they are arrested then they will opt for compromise or settlement. But if they are powerful and police do not take any action you must give complaint directly to Magistrate.

Thank you so much for all your precious time.But my mom doesn't want any case on father she just want to take her room back and want something that step brother would never do the mistake again like that.

My mom name is registered.Its her room.But she has no power on the room as I told before that the step brother taken the room and when we locked the room he also given 2 lock on the door grill.He told that if he will not use it then he will not allow anyone to use it.

make a police complaint (FIR)
and also file a case of eviction against him under the maintenance and welfare of parents and senior citizens act,
in the above act, your mother will file an application before the concerned Tribunal (SDM Court)
you can take help of local District Legal Services Authority to get free legal advice
call/mail me for full procedure
