Impact of Criminal Case judgement on Civil Case Impact of Criminal Case judgement on Civil Case

A public sector undertaking has filed a civil recovery suit against an employee (to recover losses caused due to misconduct of employee). CBI had also filed a criminal case against him in same matter. Final arguments were concluded in Criminal matter. However, employee expired before judgement and case was abated against him. In the judgement, though, the court made him accused and brought out his criminal role. The civil matter is still underway. Will the criminal court judgement have a bearing on the civil matter and will he be considered accused in criminal matter despite case being abated against him.

A.Dear Sir,
Normally both the proceedings are different proceedings with different yard sticks to be considered to dispose of the cases. However you can produce judgment of criminal case in civil recovery case it may have some effect.
