How to get divorce on grounds of mental harassment if spouse is not willing to divorce? My spouse is at her parents place for last one month. There has been serious issues at home and it has gone beyond control. However, she is not willing to divorce and wants to come back. But, for sure things will continue to escalate further. Major issue is she doesn't want to stay with my parents but, doesn't accept it in front if others and gain sympathies. Wherein, in private conversation she is regularly creating serious pressure on me. How to get divorce on such a case?

A.dear client in your matter If a wife forces he husband to discard his parents and live separately, with her, then he has the right to file divorce on such a ground. You have to prove before the court the facts and circumstances.

First file the " Restitution of Conjugal Rights" before the court. Before the filing send legal notice .

A.Go for the restitution of conjugal rights in the first step and let the party come to court with reply rest everything will take shape by its own and handled by an advocate.

A.As per Supreme Court latest decisions, If wife force to husband to live separately from old parents. It might be a solid reason to get divorce from partner.
