Legal Consultation Needed for Recovery of Funds - Section 138 Case
My name is Prashant Sharma, and I am seeking your expert legal advice regarding a financial dispute I am currently facing. A known person from my village borrowed money from me, claiming he needed it urgently due to a property sale and promised to prepare the necessary documents and sign them the following day. Trusting his word, I lent him the money. Additionally, I had previously given him money for another reason. When I later pressed him for repayment, he issued me a cheque, assuring me that he would sell his property soon and asked me to hold onto the cheque as proof. However, he has since denied taking any money from me and has even threatened to harm himself if I continue to pressurize him. It has come to light that he has taken money from several other villagers under similar pretenses. As a result, I have filed a case under Section 138 of the Negotiable Instruments Act. Given these circumstances, I am seeking your guidance on the following: 1. What legal steps should I take to ensure I can recover my money? 2. What approach should I adopt to strengthen my case under Section 138? 3. Are there additional legal avenues I should explore to address this issue? Your prompt response and expert advice on this matter would be greatly appreciated.
