According to The Insurance Regulatory and Development Authority of India (IRDAI), Insurance companies are required to settle claim usually within 30 days after receiving all the necessary documents. If you believe that, the company is delaying to settle your claim, without any reasonable cause, give a legal notice to the company, ask for immediate settlement of claim, give a time limit and mention that non-compliance of the notice shall result in legal consequences. You may file a complaint in the grievance redressal cell of the Insurance company. If it do not work, file a consumer complaint before the appropriate consumer forum. According to the provisions of IRDAI(Protection of Policyholders’ Interest) Regulations 2002, the Insurance Company will settle the claim arising out of a motor insurance policy within 30 days from the date of receipt of the last necessary documents required for assessing the claim. If the Company decides to reject a claim made under the policy, the Company shall do so within a period of thirty days of receipt of the Survey Report or the additional Survey Report, as the case may be. In the case of delay in the payment of a claim, the Company shall be liable to pay interest to the policyholder from the date of receipt of the last necessary document to the date of payment of the claim at a rate of 2% above the bank rate. However, where the circumstances of a claim warrant an investigation in the opinion of the Company, it shall initiate and complete such investigation at the earliest, in any case not later than 30 days from the date of receipt of the last necessary documents. In such cases, the Company shall settle or reject the claim within 45 days from the date of receipt of the last necessary documents. In the given scenario, you have to file a grievance over non-settlement of a claim or inordinate delay in settlement of a claim before the concerned GRO of the Insurance Compay either online or offline and if the response to the grievance is negative or rejecting your claim, then the grievance may be lodged at IRDAI Integrated Grievance Management System - https://igms.irda.gov.in/ If that grievance yield no fruitful result, then serving a legal notice to the Insurance Company, file a complaint against the Insurer for deficiency in service and unfair trade practice before the Dist. Consumer Commission under Section 35 of the Consumer Protection Act, 2019 claiming the entire amount of the claim which was repudiated/rejected along with the compensation for harassment and cost of litigation. The Complaint should be filed within two years from the date of cause of action, i.e, the date of the refusal/rejection of the claim.
