The Government of Maharashtra has issued circular dated 3rd January 2009 under section 79A of the Maharashtra Co-operative Societies Act, 1960 with object to bring clarity and transparency in the redevelopment process of society building and for the smooth functioning of the society. Section 79A of the Maharashtra Cooperative Societies Act, 1960, gives the Registrar the power to issue orders in the interest of the cooperative societies. If your society has signed a 79A agreement for redevelopment, this would have been a formalized process approved by the society's general body and likely the Registrar. The resignation of the office bearer is not likely to dissolve the committee. A new officer bearer needs to be appointed by the mean of election. We hope that our response is helpful to you.
