Received Erroneous Credit After Fraud Case: Am I Obligated to Return the Money
I was a victim of an online investment scam and lost approximately ₹26,00,000, which I transferred to six different accounts. After filing a complaint, the police were able to secure a court order to recover ₹3,35,000 from one of the fraudulent accounts.However, shortly after the court order, my bank mistakenly credited ₹28,56,407 to my account, which they later claimed was an error. I have not received any formal written confirmation from the bank regarding this erroneous credit, but they have contacted me by phone requesting the return of the excess amount. The police are also advising me to return the money.Am I legally obligated to return the entire amount, or do I have the right to retain it as part of the recovery from the fraud? What steps should I take to ensure that my rights are protected, and should I request written confirmation from the bank?Any guidance on how to handle this situation would be greatly appreciated.
