I am from India I wanted to marry divorce Bangladesh Muslim girl with pervious marriage 8year son, can I marry and what are the legal process (Gadag, Karnataka)

Under Muslim Personal Law (Sharia) there are no specific restrictions on marrying a divorced woman with children. However, the woman should be legally divorced and observe the iddah period (waiting period) after the divorce before entering into a new marriage. You can marry her even if she is muslim , under special marriage act. After your marriage is registered , you have to apply a X Visa ( Resident Visa like Green Card ) for her . It will gives her 6 years residential visa. Ensure that your prospective wife's divorce is finalized and legally recognized in Bangladesh. A notice of intended marriage must be given to the Marriage Registrar 30 days before the marriage. During this time, objections can be raised. Documents required are:- Documentary evidence of Date of birth such as passport, Pancard etc. An affidavit provided by both parties specifying the date of birth, location and time of marriage. Moreover, it should also contain martial status and nationality of both parties. Two passport size photo of both parties. One marriage photograph. Marriage invitation card, 2 witness with photograph, No objection certificate from the concerned embassy, Presence of both parties required after the submission of document, then notice will be issued of intended marriage, then a copy of notice will be pasted on the office notice board by the SDM, then any person may within 30 days of issue of notice, file objection of intended marriage.
