For recovery of debts, the statute of limitation is three years from the day the money was lent. The provision states that within three years if the lender can get an acknowledgment from the borrower regarding the sum owed, the statute of limitation begins from that date. The restriction period for debt recovery in India is typically three years from the date the cause of action arises. However, different types of debts may have different limitation periods. The restriction period usually starts from the due date of the debt or the last acknowledgment/payment made by the debtor. Secured debts generally have a longer limitation period, as they are attached to collateral security. In India, the time limit for bringing a civil recovery claim is three years from the day. Suits filed after the statute of limitations has expired will be dismissed. The reasons for seeking the exemption must be specified if the action is filed after the limitation period has expired. The Supreme Court in the case of Union of India v. Hindustan Construction Company Ltd. ruled that a money recovery litigation must be filed within three years. A plaintiff must sue within three years of the cause of action. the jurisdiction of a Civil Court to try a suit filed by a borrower against a Bank or Financial Institution is not ousted by virtue of the scheme of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993. Since there is no such power with the Civil Court, the suit can not be transferred with the consent of the plaintiff. The Supreme Court has the exclusive power to transfer civil cases from one state court to another under Article 134 (1)(a) of the Constitution of India.
